TERMS AND CONDITIONS OF SERVICE – BUZZ EXPERIENCE SRLS

These General Terms and Conditions govern the purchase and use of tourist services and experiences sold through the website www.buzzexperience.it (hereinafter, the "Website") and/or through related channels.
By making a reservation or purchase, the user declares that they have read and accepted these Terms and Conditions in full.
1) Identity of the Supplier/Organizer
The services are sold by:

(hereinafter referred to as "Buzz Experience" or "Organizer").
2) Subject of the service
Buzz Experience operates as an incoming tour operator and organizes and/or acts as an intermediary for:
guided tours and cultural visits;
excursions and experiential activities;
transfer services and tourist mobility;
boating experiences and outdoor activities;
related ancillary services (e.g., tastings, chefs, guides, etc.);
sale of vouchers/gifts.
Some experiences may be provided by selected third-party partners and suppliers (e.g., guides, skippers, drivers, facilities, local operators).
3) Booking procedures and conclusion of the contract
Reservations/purchases can be made via:
Buzz Experience website (also via WooCommerce plugin);
Online Travel Agencies (OTAs) and tourism marketplaces (e.g., GetYourGuide, Viator, etc.);
booking engine and channel manager (e.g., MailTurismo, Regiondo);
Buzz Experience physical agency (booking on site);
request via email/phone/WhatsApp with written confirmation.
The contract is considered concluded when:
the user receives written confirmation of the reservation and/or
The payment (full or partial) has been successfully completed.
4) Prices and contents of the experience
Prices are indicated on the Website and/or in the quote sent to the customer.
Unless otherwise stated, prices:
are understood to be in Euro (€);
include the items expressly indicated in the description of the experience;
do not include any extras not specified (e.g., additional drinks, unexpected entrance fees, tips, personal expenses).
Buzz Experience reserves the right to change prices and availability before confirming the order/reservation.
5) Payments
Payment can be made via:
online payment via Stripe (supported cards and methods);
other methods that may be indicated at the time of purchase.
In the event of unsuccessful or incomplete payment, the reservation may be suspended or canceled.
6) Vouchers and Gift Cards (if applicable)
If the experience is purchased as a voucher:
The voucher is non-transferable and can be used according to the conditions indicated.
The date of the experience is subject to availability and, for some activities, to weather/sea conditions.
The voucher cannot be exchanged for cash, except where required by law.
7) User obligations and participation requirements
The user undertakes to:
provide accurate and complete data;
respect the times and meeting points indicated;
follow the instructions of staff and suppliers;
behave appropriately and respectfully.
Minimum requirements may apply for certain activities (e.g., age, physical fitness, appropriate clothing).
Buzz Experience and/or the supplier reserve the right to refuse participation in the event of unsuitable conditions or dangerous behavior.
8) Punctuality, delays, and no-shows
The times indicated are binding.
In the event of customer delay, the experience may not be recoverable and reimbursement is not guaranteed.
In case of no-show, the reservation is considered used and non-refundable, unless otherwise specified.
9) Changes requested by the customer
Any requests for changes (date, time, number of participants) must be communicated as soon as possible.
The changes:
are subject to availability;
may result in price differences;
may require the application of management costs or penalties by the third-party supplier.
10) Cancellations and refunds (general rule)
Cancellation policies vary depending on the type of experience and the provider involved.
General rule: unless otherwise specified at the time of purchase or quotation, cancellation may result in penalties of up to 100% of the cost, particularly when:
the service has already been booked with a third party;
named tickets are required;
Exclusive services are provided (private boat, private transfer, private guide, chef, etc.).
To avoid disputes, the specific policy indicated in the experience sheet, voucher, or booking confirmation shall prevail.
11) Bad weather, sea conditions, and force majeure
For outdoor experiences (boating, kayaking, flights, outdoor activities), availability depends on weather and safety conditions.
In case of adverse conditions or events of force majeure (e.g., rough seas, wind, heavy rain, ordinances, strikes, closures, emergencies):
the experience can be rescheduled;
alternatively, an equivalent service may be offered;
Where this is not possible, refunds or vouchers will be issued in accordance with the applicable terms and conditions and policies of the supplier.
The technical provider (e.g., skipper/pilot/guide) and/or the Organizer is responsible for assessing safety.
12) Changes or cancellation by the Organizer
Buzz Experience may modify or cancel an experience for organizational or safety reasons (e.g., sudden unavailability of the supplier, technical failure, weather conditions).
In such cases, Buzz Experience will propose:
reprogramming;
equivalent alternative service;
refund, if applicable.
13) Liability
Buzz Experience responds within the limits set forth by applicable law.
The user acknowledges that certain experiences involve inherent risks (e.g., activities at sea, sports, excursions) and agrees to participate by exercising caution.
Buzz Experience is not responsible for:
careless behavior on the part of the user;
failure to comply with safety instructions;
lost or damaged personal belongings;
disruptions attributable to third parties not directly controllable (e.g., public transportation, external events, decisions by authorities).
14) Minors
Minors may participate only if:
accompanied by a parent/guardian, unless otherwise specified;
in compliance with any age restrictions specific to the experience.
15) Intellectual property
All content on the Website (text, images, logos, layout) is the property of the Owner or used under license.
Unauthorized reproduction is prohibited.
16) Right of withdrawal (important: not always applicable)
Under the law on distance contracts, the right of withdrawal may not apply to leisure services that have a specific date or period of performance (e.g., tours and activities booked for a specific day/time).
Therefore, for many tourist experiences with a fixed date, there is no free withdrawal within 14 days, unless more favorable conditions are indicated in the individual experience.
17) Processing of personal data
Personal data is processed in accordance with the Privacy Policy published on the Website.
18) Applicable law and jurisdiction
These Terms and Conditions are governed by Italian law.
Unless otherwise specified for the consumer, any disputes shall be settled by the court of the place where the Data Controller is based.
